These terms govern use of the Smartpath website, pre-contractual communications, and, unless a separate agreement applies, pilot or demonstration access to the product.

If you sign an order form, master agreement, DPA, or other separate commercial document with Smartpath or Navatech, that document controls in case of conflict.

1. Scope

The Smartpath website presents the product, allows you to request a demo, and lets you contact us. It does not by itself grant an automatic right to paid services, a production environment, or a particular integration.

2. Authorized users

The site and product are designed for professional use by hospitality operators, internal teams, and authorized partners. You agree to provide accurate information and use the site lawfully.

3. Prohibited uses

  • Accessing or attempting to access unauthorized areas, probing, disrupting, or bypassing site or product security.
  • Using the site to send unlawful, misleading, defamatory, malicious, or rights-infringing content.
  • Copying, decompiling, extracting, or reusing the product, content, or components beyond what the law or a written agreement permits.

4. Deployments, pilots, and pricing

Pricing, feature descriptions, and go-live timelines presented on the site are indicative and may change. Any commercial deployment, pilot, or early-access rollout may be subject to validation, availability, onboarding, and a separate written agreement.

5. Customer data and compliance

The customer remains responsible for the lawfulness of data provided to Smartpath and for the instructions given for product-side processing. When Smartpath processes personal data on behalf of a hotel customer, data protection obligations are defined in the contract and, where applicable, in a data processing agreement.

6. Intellectual property

The site, product, Smartpath brand, text, visuals, interfaces, software, and related content remain the property of Smartpath, Navatech, or their licensors. No rights are transferred except where a written agreement expressly says otherwise.

7. Availability and changes

We may evolve, fix, suspend, or withdraw all or part of the site, a feature, or a pilot when needed for technical, security, regulatory, or product reasons. We aim to keep the site available but do not guarantee uninterrupted or error-free access.

8. Warranties and liability

To the extent permitted by applicable law, the site is provided on an as-is and as-available basis. Unless mandatory law or a written contract says otherwise, Smartpath disclaims implied warranties and is not liable for indirect, consequential, or lost-profit damages arising from site use.

9. Suspension and termination

We may suspend or terminate pilot access, communications, or use of the site where there is abuse, a security risk, a breach of these terms, or a legal requirement to do so.
